Is Pavement Parking Legal?

From time to time, we all park on the pavement. But the question is, Is it Legal? Currently, it is only against the law to park on the pavement in London Boroughs. Anywhere else in the UK, the motorist is free to park on the pavements as well as the road.

Parking on Pavements in Scotland

The Transport Bill in Scotland will soon introduce a national ban on pavement parking and double parking. This is to make pavements and roads more accessible and safer for pedestrians. Stuart Hay, Director of Living Streets Scotland comments: “This is the beginning of the end for footway parking in Scotland.” He continued saying that Scotland will be the only part of the UK to have clear laws on footway parking. The UK Government is reviewing the situation the ban could eventually also be introduced across England and Wales.

The Highway Code

Rule 244 of the Highway Code states: “You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. The word “MUST NOT” in the Highway Code implies that it is against the law. The word “Should” implies it is advisable.

Parking Surveys

Recent surveys on parking have indicated millions of UK residents park o  the pavements daily. That’s about one in every ten motorists. With an estimated 31 million cars, that about 3 million of us parking daily on the pavements. The outcome would affect the parking habits of millions of us. The surveys have also revealed a 50/50 split of those motorists in favour and against pavement parking.

The advice from the team at DTC UK is to consider all other road users. Where pavement parking is allowed, always leave enough room for pedestrians to pass through.
